Terms and Conditions

The purpose of these General Terms & Conditions (hereinafter the "T&Cs") is to determine the conditions of access and rules of use under which the website zou.maregionsud.fr (hereinafter the "Website") provides a service making dedicated content available online via the following link: zou.maregionsud.fr/en/

These terms and conditions are enforceable, deemed to have been read and applicable on the date of first use of the website by the user (hereinafter the "User") as defined in these T&Cs. By visiting this website, you unreservedly accept these Terms and Conditions, which are enforceable against you.

Sud Mobilités Technologies (hereinafter "SMT") reserves the right to refuse access or exclude, without prejudice to any damages and interest for the User and without prior notification, any User who does not comply with these Terms and Conditions.

SMT reserves the right to modify or update these Terms & Conditions at any time, unilaterally, at its discretion, in order to comply with any legal, jurisprudential, editorial and/or technical changes or additions. It is therefore the User's responsibility to regularly refer to the latest version of the Terms & Conditions, which are permanently available on the Website. In the event of a modification to the T&Cs, a window containing the modified T&Cs will be displayed. The User must accept the new T&Cs by ticking the box "I have read the T&Cs in their entirety and I accept them".

In the event of disagreement with the T&Cs, the User may not use the Website.

Article 1 – Definitions

Within these T&Cs, words or expressions beginning with a capital letter shall have the following meanings:

 

Cookie(s): refers to computer files stored on the hard drive of the User's computer.

 

Publisher: refers to SMT

 

Information: refers to all Information and publications accessible on the Website.

User(s): refers to the natural person using the services offered by the Website.

Article 2 – Purpose of the Website

The purpose of the Website is to provide Users with:

  • services for purchasing ZOU ! train tickets;
  • services for purchasing ZOU ! bus tickets;
  • services for purchasing Train des Chemins de Fer de Provence (CP) tickets;
  • the option to choose a bicycle shelter;
  • the option to order a discount card or a profile ticket;
  • the option to order a ZOU ! Card;
  • seat reservation services for ZOU ! buses;
  • a route search service;
  • a timetable search service;
  • a traffic information search service;
  • a customer account service;
  • a translation service in 4 languages.

 

Any use of any of the Services offered by the Website shall be in accordance with these Terms & Conditions. The User is informed that SMT may terminate or modify the characteristics of the services offered on the Website at any time, without notice and without the User having any recourse against SMT.

Article 3 – Access to and use of information on the website

3.1 Accessibility to the Website

The Website can be accessed from a computer, tablet or smartphone connected to a telecommunications network in accordance with the communication protocols used on the Internet.

The Publisher grants the User the right to consult, use and access the Information on the Website.

3.2 Cost of the Website

Access to the Website is free of charge and is not subject to any subscription. All software and hardware necessary for the use or operation of the Website Services, access to the Internet or communication costs are the sole responsibility of the User outside their place of work.

Each User is entirely responsible for their own login details. Unless proven otherwise, any connection to the Website or transmission of data made using the User's login details will be deemed to have been made by the User.

3.3 Duration of access

The User's access to the Website is for an unlimited period, without prejudice to the right of the User or SMT to terminate unilaterally, at any time, without notice, justification or compensation.

The User acknowledges that in the event of a breach of the provisions of the law and/or these Terms of Use, SMT may block and/or terminate access to the Site without prior notice, with immediate effect.

The User shall refrain from, without this list being exhaustive, the following:

  • use the Site for commercial purposes and, in general, to offer products and services that generate direct or indirect remuneration;
  • "resell" or make available to a third party and/or other Users, for a fee and/or free of charge, the content of the Site;
  • use the Website to send, in any form whatsoever, unsolicited advertising or promotional material;
  • direct Internet users indirectly or directly, in particular via hypertext links, to other websites that may not comply with applicable legislation or the T&Cs.

3.4 Customer Account

The creation of a customer account is necessary to access certain services offered on the Website. When creating an account, the User undertakes to provide accurate, complete and up-to-date information, and to keep it that way for the entire duration of use of the service.

Login details (username and password) are strictly personal and confidential; the User is solely responsible for keeping them safe and for any use made of their account. 

Any connection or transmission of data made from the account is deemed to have been made by the User. In the event of loss, theft or fraudulent use of their login details, the User undertakes to inform the Publisher immediately. The Publisher reserves the right to suspend or delete an account without notice in the event of a breach of the Terms of Use, fraudulent use or use that contravenes the regulations in force.

Personal data associated with the customer account is processed in accordance with applicable regulations on the protection of personal data, in particular Regulation (EU) 2016/679 (GDPR), in accordance with the terms described in the Privacy Policy.

Article 4 – Availability of the Website's services

The Website is accessible 24 hours a day, 7 days a week, except in cases of force majeure or events beyond SMT's control.

However, SMT reserves the right to suspend, interrupt or limit, without prior notice, access to all or part of the Website, in particular for maintenance and updates necessary for the proper functioning of the Website and related equipment, or for any other reason, in particular technical reasons.

SMT is under no obligation to ensure technical accessibility to the Website. SMT shall in no event be liable for any interruptions and the consequences that may result for the User.

Article 5 – Website Hosting

Users are expressly informed that the content published on the Website and associated applications is hosted by AWS, based in Paris.

Article 6 – Intellectual property

In general, the User shall refrain from infringing the intellectual property rights (copyright, related rights, sui generis rights of database producers, trademark rights, domain names, etc.) of SMT and/or any third party.

 

SMT owns all intellectual property rights to both the structure and content of the Website (text, logos, images, sound elements, software, icons, layout, database, etc.) or has duly acquired the rights to use the structure and content of the Website without limitation.

 

Users are therefore prohibited from copying, reproducing, representing, modifying and/or exploiting, transferring in any way whatsoever and for any purpose whatsoever, all or part of the structure and content of the Website, except with the express prior written authorisation of SMT.

 

Any downloading is strictly prohibited, unless expressly authorised by SMT. Any abusive downloading that is detected may result in SMT and/or any third party concerned taking appropriate sanctions.

 

The trademarks and logos reproduced on the Website are registered with the relevant authorities by the companies that own them. Any reproduction of the names or logos, by any means whatsoever, without the prior authorisation of the owner concerned is prohibited.

 

Failure to comply with these prohibitions may constitute an act of counterfeiting and/or unfair and parasitic competition, engaging the civil and/or criminal liability of the User.

Article 7 – Hyperlinks

In the event that the Website contains hypertext links to other websites, it is your responsibility to familiarise yourself with the policies of the websites to which the Website links, particularly with regard to the protection of personal data.

 

For all intents and purposes, it is hereby reiterated that Users may not place hyperlinks to other websites.

Article 11 – Warranties

When using the Website, the User undertakes not to contravene the laws and regulations in force and these Terms of Use.

 

The User is informed that any violation of these provisions may result in legal proceedings and penalties against them.

 

Under the same conditions, the User also undertakes to comply with internal rules and practices relating to the use of SMT's information systems and networks.

 

The User undertakes to act diligently to respond to any complaint. The User is liable to SMT and/or third parties for any material and/or immaterial, direct and/or indirect damage of any kind caused by the User and/or their employees in the event of non-compliant use. The User indemnifies SMT and its parent companies, sister companies or affiliates, representatives, employees and partners against any claim, complaint, demand and/or recourse of any kind resulting from any violation of these provisions.

 

The User shall indemnify them, at any time and upon first request, against any damage and/or any claim, action or complaint from third parties resulting from any violation of these provisions. This guarantee covers both any damages that may be paid, regardless of their direct or indirect origin, and lawyers' fees, expert fees, legal costs and tax costs.

 

In general, SMT disclaims all liability in the event of use of its services that does not comply with the Terms & Conditions.

 

SMT undertakes to make every effort to implement technical and organisational measures to protect the Information circulating on the Website.

 

The User nevertheless declares that they are fully aware that the data is not protected against all forms of intrusion, including hacking. The User acknowledges that it is impossible to guarantee total security for the data transmitted. Consequently, SMT cannot be held liable for any incidents that may arise from this transmission. It is the User's responsibility to implement all appropriate measures to preserve the confidentiality of the data transmitted.

Article 13 – Invalidity of a clause

The invalidity of all or part of one or more provisions of these Terms & Conditions, pursuant to a legal or regulatory provision or a final court decision, shall not invalidate the other provisions or the part of the provision that is not affected by the invalidity.

 

Article 14 – Applicable law – Dispute resolution

These Terms & Conditions are subject to French law.

In the event of any dispute relating to the interpretation, validity or enforcement of these Terms & Conditions, the User and SMT agree to use their best efforts to settle the dispute amicably.

In the event that an amicable agreement cannot be reached, any dispute relating to the interpretation or execution of these Terms & Conditions shall be submitted to the competent courts of Marseille.

Transports ZOU !'s social media accounts are open to all internet users. They were created to build a friendly community around Transports ZOU ! and its news, but also to encourage dialogue and discussion.

This user charter has been created to clarify to users of ZOU ! pages the conditions for respectful use of the pages' discussion forums, in addition to the general Terms & Conditions of META (T&Cs) and LinkedIn.

By becoming a "fan" of the ZOU ! Facebook, Instagram and LinkedIn pages, users accept the rules and conditions of use of this charter and the META T&Cs (terms and conditions of use) and undertake to comply with them. ZOU ! undertakes:

  • not to publish any misleading information intended to deceive consumers;
  • to endeavour to respond promptly to fans;
  • to justify, by sending a private message, any deletion that does not comply with the moderation rules.

Contribution rules:

  • Users of ZOU ! pages and accounts undertake to ensure that the content of their contributions complies with the laws and regulations in force, as agreed in META's terms and conditions of use (T&Cs).

  • and more generally, any other legislative or regulatory provision in force;
  • contributions likely to damage the image or reputation of the brand or of a natural or legal person;
  • calls for boycotts are prohibited under current law.

  • your contributions must be courteous in order to ensure that discussions run smoothly;
  • your contributions must use correct and understandable language.

Moderation:

  • By becoming a user of ZOU !'s Facebook, Instagram and LinkedIn pages, you acknowledge that the page moderator may monitor contributions and delete, at any time, any contribution that contravenes the provisions of the paragraph entitled "Contributor's rights and obligations" or that the moderator deems to be inconsistent with the spirit of exchange, conviviality and respect that animates the discussion spaces constituted by the "Wall" of the ZOU ! pages.
