Article 1 - Introduction

Sud Mobilités Technologies' corporate purpose is the distribution of transport tickets and passenger information, which are the subject of its own processing operations, carried out under the terms of this privacy policy.

The protection of your privacy is a key priority, and we use your personal data to provide you with our services in accordance with the General Data Protection Regulation.

As such, here are the eight principles that Sud Mobilités Technologies adheres to:

  • Never collect or use data without a specific and legitimate purpose;
  • Only collect data in one of the following circumstances:
    • The data is necessary for the performance of contracts and services requested;
    • You have given your express and specific consent in cases where this is required;
    • We have a duly justified legitimate interest in processing your data;
    • Only collect and use data that is strictly necessary for processing;
    • Only store data for a limited period of time consistent with the services provided;
    • Ensure the quality and security of data at all times;
    • Only transfer data when necessary, and in compliance with legal and security rules;
    • Provide you with clear and transparent information at all times;
    • Ensure that your rights and the conditions for exercising them are respected;
    • Ensure that your data is hosted in compliance with the GDPR.

This privacy policy applies to all Sud Mobilités Technologies websites, mobile applications and services.

Article 2 - Data collected, retention period, purposes of processing and legal bases

Data collected and retention period

Sud Mobilités Technologies scrupulously adheres to the principle of minimisation, i.e. collecting only data that is strictly necessary for the purposes defined below:

  • Identification data (surname, first name, date of birth, e-mail address, commercial or loyalty card numbers, travel reference): this data is essential for any order, customer account registration or for the security of SMT's websites and transactions, and concerns the purchaser and the passengers concerned;
  • Travel document – identity card, passport (type, number, expiry date, country of issue): this data is essential for certain international journeys and is requested by the carrier for border control purposes.
  • Payment data (credit card number, order amount, holiday voucher number and expiry date, etc.): this data is essential for any order or refund. You can also save your bank details in your customer account to facilitate future purchases;
  • Data related to your searches and your order (product purchased, destination, date, cards and/or subscription claimed, etc.): this data is essential to provide the service ordered and after-sales service;
  • Where applicable, generic data related to the presence of a disability (collection of "disabled traveller" and "wheelchair user" status): this data is essential for adapting our offer to disabled persons and making it accessible to all (proposal of comfort and assistance facilities, fare adjustment, appropriate seating, etc.);
  • Data related to your habits and interests (favourite destinations, choice of additional services, etc.): this data is useful for proposing personalised offers;
  • Contact details (telephone number, e-mail address, postal address): this data is useful for:
    • contacting you if necessary (problems related to the service, your order or the product purchased) and concerns the purchaser and/or passengers concerned;
    • informing you in real time in the event of disruption, cancellation or delay affecting your journey;
    • ensuring that your rights to assistance, re-routing or reimbursement are implemented in accordance with Regulation (EU) 2021/782 of 29 April 2021 on the rights and obligations of rail passengers;
    • communicate with you in connection with the follow-up of complaints or the management of compensation.
  • Technical data (browser version, operating system, device model, IP address, etc.): this data is necessary for the optimal display and functioning of ZOU ! websites and applications;
  • Geolocation: the ZOU ! mobile application includes a geolocation feature that can only be activated with your consent. This data allows us to offer you personalised services and offers (nearest station/next departure from the nearest station) or to proactively offer you an exchange of your tickets in the event of an estimated delay on your part (calculation of the distance from your geolocation to the station and the departure time/connection to the customer account and activation of continuous geolocation required). You can deactivate geolocation at any time in your phone settings. When you agree to share your location continuously, you are also helping to improve the public transport service, as the data is aggregated for mobility studies intended for various transport operators.
  • Browsing data (searches, number of visits, date of last visit, etc.): see the "Manage your cookies" tab.

Data is only kept for as long as is strictly necessary:

  • To fulfil orders;

  • To comply with legal and regulatory requirements, particularly with regard to dispute management;

  • To ensure the proper functioning of SMT services (particularly customer accounts);

  • To offer personalised services.

The general data retention policy for SMT services is as follows:

  • Identification data: 3 years from the last date of visit to the website or connection to customer service;

  • Order data: 3 years from the date of order;

  • Bank details:

    • Either a maximum of 13 months for after-sales management (refunds);

    • Or for the duration of the bank card's validity if you have registered it on your customer account.

  • Prospect data: 1 year after the date of last activity on SMT services or last opening of a newsletter;

  • Connection logs: 1 year from each connection;

  • Cookies: a maximum of 13 months from when they are stored on your computer or device;

  • Geolocation data: only for the duration of the browsing session, or in the background if you have agreed to this.

Article 3 - Recipients

Your data is intended for SMT staff, partners (Batch Media, Batch Service, Calameo, Datadog, Datadog marketing, Facebook, Google Advertising products, iFrame, Instagram, Linkedin Corporation, Microsoft (Bing ads), Microsoft Advertising, Omniture, Tiktok, Vimeo Inc, Youtube) and service providers of SMT and the Région Sud, to third parties for legal reasons, where applicable. SMT undertakes not to disclose your personal data to any third parties other than these subcontractors and partners affiliated with ZOU !

At the end of the public service delegation, your customer data will be transferred to the organising authority and/or the new transport operator in order to ensure the continuity of the public service.

Under no circumstances will SMT sell, transfer or exchange your personal data to third parties for commercial purposes.

Article 4 - Your rights

In accordance with current European regulations, users of https://zou.maregionsud.fr/en/ have the following rights:

– right to access (Article 15 of the GDPR) and rectify (Article 16 of the GDPR), update and complete User data the right to block or erase personal User data (Article 17 of the GDPR) when it is inaccurate, incomplete, ambiguous, outdated, or whose collection, use, communication or storage is prohibited;

– right to withdraw consent at any time (Article 13-2c of the GDPR);

– right to restrict the processing of User data (Article 18 of the GDPR);

– right to object to the processing of User data outside of the obligations related to the performance of the contract (Article 21 of the GDPR);

– right to object to the processing of User data outside of the obligations related to the performance of the contract (Article 21 of the GDPR);

– right to the portability of data provided by Users, when such data is subject to automated processing based on their consent or on a contract (Article 20 of the GDPR);

– right to determine the fate of User data in the event of death and to choose to whom https://zou.maregionsud.fr/en/ shall communicate (or not) their data to a third party they have previously designated.

As soon as https://zou.maregionsud.fr/en/ becomes aware of the death of a user and in the absence of instructions from them, SMT undertakes to destroy their data, unless its retention is necessary for evidentiary purposes or to meet a legal obligation.

If the User wishes to know how https://zou.maregionsud.fr/en/ uses their Personal Data, request to rectify it or object to its processing, the User may contact SMT in writing at the following address:

In this case, the User must indicate the Personal Data that they would like https://zou.maregionsud.fr/en/ to correct, update or delete, identifying themselves precisely with a copy of an identity document (identity card or passport).

Requests for the deletion of Personal Data will be subject to the obligations imposed on SMT by law, particularly with regard to the storage or archiving of documents.

Finally, Users may lodge a complaint with the supervisory authorities, in particular the CNIL (https://www.cnil.fr/en).

 

Data relating to minors

In the context of the digital provision of our products and services, personal data relating to minors under the age of sixteen (16) may be collected. This collection takes place exclusively under the control and with the prior authorisation of their legal representatives (parents or guardians).

Users of our digital services who declare that they are under the age of sixteen (16) have the right to have their personal data deleted, subject to compliance with our legal retention obligations as defined in Article 2 entitled "Use of collected data and retention periods".


This right may be exercised at any time and without justification, either directly by the data subject or through their legal representative, by contacting us in accordance with the procedures set out in Article 4, "Your rights".

What is a cookie or a tracker?

These are files stored in the browser of your computer or mobile device when you browse ZOU ! services. These files are then automatically sent by the browser to Sud Mobilités Technologies servers when you browse in order to:

  • Enable browsing on our sites (login sessions, authentication evidence for the "remember me" function, servers used, etc.);
  • Track customer browsing on websites, applications and newsletters to ensure optimisation;
  • Personalise journeys and offers;
  • Manage advertising on ZOU ! services.

The main purpose of these cookies and trackers is to display advertising content that may be of interest to you, based on data collected when you browse our services or external websites or social networks.

Cookies for technical purposes:

  • Browsing sessions (customer account login, technical browsing session, servers used)
  • Simplification of the visit by adapting to the display criteria of your computer or terminal (language used, display resolution, operating system, browser used, accessibility settings)

  • Automatic reconnection to the customer account (when activated)

These cookies are necessary for the proper functioning of the website and the ZOU ! application and for your browsing, and therefore cannot be configured.

Cookies used for tracking purposes:

  • Audience measurement: statistical data on visits to and use of Sud Mobilités Technologies websites (targeted sections and content, browsing history) in order to measure and study the functioning and effectiveness of our services, and thus improve their appeal and usability;
